Israel’s Supreme Court lambasted the government this week for disobeying a temporary injunction to stop work on a West Bank road. This isn’t the first time the court has complained of governmental noncompliance with its orders; as various commentators have noted (here and here, for instance), noncompliance is rapidly becoming routine. Yet both court and commentators tend to overlook the court’s own responsibility for this problem.

In March, Haaretz published a list (Hebrew only) of nine court orders the government had yet to obey. They included orders to build 245 new classrooms in East Jerusalem, to reinforce every school within rocket range of Gaza against rockets, to build a high school in an Arab village, to relocate the security fence near the West Bank village of Bili’in, and to do the same near the village of Azzoun.

These rulings have one thing in common: each would cost hundreds of millions of shekels to implement; collectively, they would cost billions. Thus to obey them, the government would have to slash billions of shekels from other parts of the budget. And while I favor budget-cutting, most quick and easy big cuts would have disastrous consequences: slashing welfare, say, or canceling all army training exercises. Productive cuts, such as eliminating unnecessary layers of civil-service bureaucracy, are neither quick nor easy, as they would entail major fights with powerful government unions. Thus in the real world, there is no practical way to promptly obey all the court’s rulings.

But aside from the practical problem, these rulings embody a more fundamental problem: the judicial usurpation of government prerogatives. Clearly, such rulings reduce the government’s ability to set its own budgetary priorities, but the problem goes way beyond budgets.

Take the ruling on reinforcing schools against rockets. Governments certainly should protect their citizens, but how best to do so is a judgment call, of precisely the sort citizens elect their governments to make. There is no legal basis for the court to require the government to protect its citizens via one particular method, by reinforcing schools, rather than, for instance, by military action against Hamas (which, when Israel finally tried it 17 months ago, proved quite effective).

Similarly, while the government is legally obligated to provide schooling, there is no legal basis for requiring it to build a high school in one particular village rather than, say, busing students to school in a neighboring town.

The practical impossibility of implementing some of the court’s orders, combined with increasing resentment of the court’s usurpation of governmental prerogatives, has generated a response of passive resistance — i.e., noncompliance. But once governments get in the habit of ignoring court orders, it quickly spreads even to orders that there are no grounds for disobeying, like this week’s injunction. And the result is anarchy.

The only way to stop this dangerous trend is by prompt legislative action to restrain the court’s growing reach. But unfortunately, no government has yet had the stomach for the public battle this would entail. It’s much easier to just keep quietly disobeying court orders.

Recent articles about the Obama administration’s preference for enemies over allies ring depressingly familiar to Israelis, whose country is a past master of that perverse art (see, for instance, its treatment of the South Lebanon Army and the Druze). Thus it was encouraging to learn that Benjamin Netanyahu’s government has for once preferred an ally to an enemy, by twice rejecting Qatar’s offer to restore low-level relations.

Qatar opened trade relations with Israel in 1996, then severed them during Israel’s war with Hamas in the Gaza Strip in January 2009. But about six months ago, Haaretz reported, Qatar offered to let Israel reopen its trade mission in Doha if Israel would let it bring large quantities of cement and other construction material into Gaza, grant it leadership over efforts to rebuild the Strip, acknowledge its regional status, and publicly laud its regional role. It reiterated this offer four months later. Both times, Israel refused.

The initial report attributed Israel’s refusal to security concerns: fear that Hamas would use the Qatari construction material “to build bunkers and reinforced positions for missile launches against Israel.” That in itself was encouraging: after 17 years of “risks for peace” that, without exception, led to suicide bombings and rocket barrages, it’s reassuring to know that this government puts security first. Still, reasonable people could disagree over whether the risk truly outweighed the benefits of relations with another Arab country.

But a subsequent report removed all doubts about the decision’s wisdom. The real reason for Israel’s refusal, it said, was not security but Egypt’s objection: at a time when Cairo is taking enormous flak from the Arab world for blockading Gaza’s southern border, at Israel’s request, it would be intolerable for Israel to let Qatar become the Arab world’s hero by breaking the blockade.

Israel has many legitimate grievances against Egypt, from its viciously anti-Semitic state-controlled press to its insane effort to make Israel, rather than Iran, the focus of this month’s NPT Review Conference. Nevertheless, Egypt has on balance proved a valuable ally. Qatar has proved the opposite.

Unlike Qatar, Egypt has never used Israel’s counterterrorism efforts as an excuse for severing its ties with Jerusalem. Moreover, it has led Arab opposition to the Iran-Syria-Hezbollah-Hamas front, whereas Qatar has cozied up to this front: for instance, Doha brokered the 2008 agreement that granted Hezbollah veto power over Lebanon’s government, and it is planning joint military exercises with Iran.

And unlike Qatar, which seeks to bolster Gaza’s Hamas government by rebuilding the Strip, Egypt, after some initial faltering, is now striving to undermine Hamas by enforcing the blockade. And it’s working: in part because Hamas can no longer smuggle large quantities of cash across the Egyptian border, its revenues have fallen steeply, forcing it to impose new taxes that have proved deeply unpopular.

Thus for all its flaws, the Egyptian alliance is worth preserving — and certainly shouldn’t be sacrificed to gain a “friend” like Qatar, which has consistently worked against Israel’s interests. That may seem self-evident. But given Israel’s history of favoring enemies over allies, Netanyahu’s government deserves kudos for recognizing it.

Syrian President Bashar Assad’s candid interview this week with Lebanon’s As-Safir paper ought to be studied by anyone who still believes in either the possibility of Israeli-Syrian peace or the utility of Western engagement with Syria.

According to both the Jerusalem Post and Ynet (the website of Israel’s largest daily, Yedioth Ahronoth), Assad told As-Safir that Israeli President Shimon Peres sent a message via Russia offering him the entire Golan Heights if Syria would sever ties with Iran and with terrorist groups like Hezbollah and Hamas. But Assad said he wasn’t interested: He refuses to abandon the option of “resistance.”

Whether or not Peres actually made this offer (which his office vehemently denies) is irrelevant. The point is that Assad claims it was made. Yet his response was not to pursue it via direct or even indirect talks with Israel. It was to assert that Syria will never pressure Hamas and co. to disarm; that Israel doesn’t want peace anyway, so there’s no point in talking; and that it would be a “mistake” to “erase the resistance option,” thereby “becoming hostage to the peace option.”

This response has three noteworthy aspects. First, Israeli advocates of peace with Syria all claim that previous talks collapsed over one single issue: Jerusalem insisted that the border be the recognized international border, while Damascus demanded the pre-1967 border, which includes Israeli territory that Syria illegally occupied in 1948. Therefore, they argue, if Israel would just stop fussing over that sliver of land and cede it all, a deal would swiftly be signed.

Second, these advocates always said peace would bring one major benefit: Syria’s removal from the Iran-Hezbollah-Hamas axis.

Yet now, Assad claims that Peres offered precisely what Israeli peace advocates always wanted: the whole Golan. And he contemptuously refused to pay the desired quid pro quo.

Most noteworthy of all, however, was his reason: Abandoning “resistance” would be foolish, because it works. And as evidence, he cited Syria’s renewed ties with the West, especially Washington. In short, he views the Obama administration’s engagement drive as proof that supporting terror pays.

Moreover, when asked to identify Syria’s key regional interests, peace with Israel didn’t make the list — but “dialogue with the U.S.” did. Thus peace with Israel no longer offers any compensation that would justify abandoning “resistance”: The one benefit it was traditionally thought to offer — an opening to Washington — has now been achieved by “resistance” instead.

This also explains why Assad eagerly engaged in indirect talks with former Israeli Prime Minister Ehud Olmert just two years ago, but scorns the idea today. Then, he was being boycotted by the West, and especially by former President George W. Bush, so talks with Israel were needed to end the boycott. Today, he is courted by Europe and Washington alike. So who needs peace with Israel?

The conclusion is clear: As long as Assad can get everything he wants from the West without a peace deal, Israeli-Syrian peace will be unattainable. Only when the West starts punishing “resistance” rather than rewarding it will Assad’s strategic calculation change.

One thing pretty much all Israeli commentators agree on is that Western acceptance of the Iran-Brazil-Turkey nuclear deal would be a disaster for Israel.

Unlike the original deal on which it is modeled, and which Iran rejected last fall, this deal makes no pretense even of delaying Iran’s nuclear program. The original deal sought to buy time by transferring most of Iran’s enriched uranium outside the country, leaving it without enough to build a bomb until it enriched more. This deal would transfer a much smaller percentage of Iran’s uranium overseas, and would thus still leave it with enough to build a bomb.

Yet Western acceptance of it would not only kill any chance for tougher sanctions on Iran (no great loss, since the sanctions effort wasn’t going anyplace anyway); it would also make it much harder for Israel to take military action against Iran: Israel would then be portrayed as the warmonger ruining the world’s chances for peace in our time.

As Israel’s government contemplates this grim scenario, it might do well to read a new book on the Russian-Georgian war of 2008 — or at least Prof. Shlomo Avineri’s review of it in Haaretz.

In A Little War That Shook the World, former State Department official Ronald Asmus chronicles the events leading up to the war and its disastrous consequences for Georgia: it lost its last remaining foothold in the separatist regions of Abkhazia and South Ossetia, saw hundreds of its citizens killed and tens of thousands turned into refugees, and effectively destroyed its chances of joining either NATO or the European Union.

Yet Asmus thinks a Georgian failure to respond to Russia’s provocations would have had even worse consequences, Avineri notes: President Mikheil Saakashvili’s government “would have been toppled and there may well have been a coup d’etat in Tbilisi, which could have resulted in a particular well-known pro-Russian politician taking Georgia’s helm. In effect, Georgia could have lost its independence and become a Russian satellite once again” — for the third time in two centuries.

Avineri finds Asmus’s conclusion persuasive. But even if one doesn’t, it is hard to argue with Avineri’s conclusion. “There is something of a moral here for small countries,” the dovish professor writes. “Sometimes, being unwilling to give in is strategically the right move, even if it exacts a high price.”

An Israeli strike on Iran’s nuclear facilities would exact a very high price: military counterstrikes by Iran, Hezbollah, Hamas and perhaps Syria; international opprobrium; a schism with Washington; and perhaps even international sanctions. And that would be true even if the West ultimately rejects the Brazil-Turkey deal and returns to the Obama administration’s plan A: declaring the problem “solved” by passing another watered-down sanctions resolution that, like its predecessors, will do nothing to halt Iran’s nuclear program.

Nevertheless, the consequences to Israel of a nuclear Iran could well be even worse. And if so, Israel’s government might have to decide that the price of military action is worth paying.

Israel’s left-wing daily Haaretz isn’t one to cry uncle. “There will be no economic prosperity without peace,” it defiantly titled today’s editorial — published two days after Israel was admitted, by unanimous vote, to the club of the world’s wealthiest nations: the OECD.

“The link between the economic and political is clear,” the editorial asserted, serenely untroubled by the facts. “There can be no sustained economic growth without a substantive compromise with the Palestinians and Syria.”

The facts, of course, are that if sustained economic growth required peace, Israel could never have earned OECD entree: the country has been at war since its establishment in 1948, when it was attacked by five Arab armies. It fought conventional wars again in 1956, 1967, 1973, and 1982. It was bombarded by Iraqi missiles during the 1991 Gulf War. It fought asymmetric wars against terrorist organizations in the West Bank in 2002, Lebanon in 2006, and Gaza in 2009. And in between all the wars, it suffered nonstop terror attacks.

Some of these wars indeed produced temporary recessions. Yet the overall pattern has been one of, yes, sustained growth. Had it not, Israel would not today be the only one, out of dozens of countries established in the post-colonial upheavals that followed World War II, invited to join the OECD. It certainly wasn’t because its fellow OECD members love it so much: many routinely vote against it in other international forums.

But if Haaretz were merely spouting harmless nonsense, nobody would care. The problem is that this particular nonsense is deadly dangerous, because the editorial is right about one thing: “Israel’s economic status is conditional.” Wise choices by Israel’s leaders can facilitate continued growth; bad choices can reduce or even destroy it: look at Greece.

Yet for much of the past two decades, Israel’s leadership has been consumed with either pursuing an unobtainable peace or trying to contain the terrorist onslaughts that every such effort has spawned. The crucial domestic issues on which economic success in fact depends have consequently been neglected. Israel’s schools and universities are in free fall, which bodes ill for a country whose only natural resource is brainpower. And bureaucratic obstacles to doing business remain a fact of life.

Prime Minister Benjamin Netanyahu actually does care about domestic issues. As finance minister in 2003, he implemented economic reforms that produced five straight years of rapid growth, and his campaign for prime minister included detailed proposals for additional domestic reforms. But since taking office, he, too, has been consumed by the “peace process” — or rather, the crisis with Washington it has generated. Domestic reforms have fallen by the wayside.

And that is why the Haaretz fallacy is so dangerous. Roughly every other Israeli prime minister has, like Haaretz, viewed peace as essential to Israel’s survival and therefore devoted himself to fruitlessly pursuing it. Each of their successors has then had to devote himself to containing the fallout. And as long as this pattern continues, vital domestic issues will continue to be neglected.

Peace would certainly benefit Israel’s economy. But continued pursuit of a peace that is unobtainable could destroy it.

The newly launched Israeli-Palestinian “proximity talks” have two remarkable features. One is the consensus, even among doves, that the talks have no chance of success. The other is the consensus that the onus for their success rests entirely on Israel.

Regarding the first, here are two of many examples: David Makovsky of the Washington Institute for Near East Policy, once an enthusiastic peace-processor, warned last month that “whenever it is all-or-nothing in the Middle East, it is nothing. We should not set ourselves up for failure.” Avi Issacharoff, who covers Palestinian affairs for left-wing Haaretz, published an analysis whose title says it all: “Indirect Mideast peace talks – a highway to failure.”

Regarding the second, even Barack Obama’s media cheerleader-in-chief, Roger Cohen of the New York Times, noticed the embarrassing imbalance: “Israel will refrain from provocations of the Ramat Shlomo kind (those planned 1,600 housing units in East Jerusalem) and will promise to get substantive, on borders above all. Palestinians will promise to, well, show up.”

And Secretary of State Hillary Clinton was explicit about it. Addressing the American Jewish Committee last month, she declared: “Israel must do its part by respecting the legitimate aspirations of the Palestinian people, stopping settlement activity, addressing the humanitarian needs in Gaza, and supporting the institution-building efforts of the Palestinian Authority.” The Arab states also have obligations, like helping to fund the PA and backing its negotiating efforts. And the PA’s obligations? About that, she hadn’t a word to say.

Putting these two facts together, what emerges? Noah suggested that the talks’ inevitable failure is actually the point, as it will give Obama an excuse for imposing his own peace plan. I agree with the first half of this conclusion. But if the goal were merely an Obama peace plan, it wouldn’t be necessary to place the onus on Israel in advance: any impasse, regardless of who was to blame, would provide an equally good excuse.

Therefore, I think the goal is simpler: to provide an excuse for putting more “daylight” between America and Israel — presumably entailing substantive sanctions rather than merely the hostile rhetoric employed hitherto — and thereby further Obama’s goal of rapprochement with the Arab world.

Why is the proximity-talks charade necessary? Because currently, Obama lacks both public and congressional support for moving beyond mere verbal hostility. If he didn’t realize this before, the backlash to his March temper tantrum over Ramat Shlomo would certainly have convinced him.

So he needs to up the ante by painting Israel’s government as responsible for torpedoing a key American foreign-policy initiative — one he has repeatedly framed as serving both a vital American national interest and a vital Israeli one. He could then argue not only that Israel deserves punishment but that such punishment would actually serve Israel’s interests.

To avoid this trap, Jerusalem must launch its own PR campaign in America now to put the focus back where it belongs: on Palestinian unwillingness to accept a Jewish state. For if Israel lets Obama control the narrative, the public and congressional support on which it depends may be irretrievably undermined.

The new European group JCall raises a disturbing question: how could pro-Israel intellectuals like Alain Finkielkraut and Bernard-Henri Levy support a venture that is simultaneously anti-Israel and intellectually incoherent?

JCall presented a petition to the European Parliament this week that asserted that Israel’s future “depends upon” peace with the Palestinians, so the European Union must “put pressure on both parties.” Then, abandoning the pretense of even-handedness, it added: “Systematic support of Israeli government policy is dangerous and does not serve the true interests of the state of Israel.” There was no comparable warning against supporting Palestinian Authority policies, some of which clearly endanger Israel.

Asked to explain this disparity, founder David Chemla told the Jerusalem Post, “As Jews tied to Israel, we speak to the Israelis. So this is a call to the Israelis.”

That is obvious nonsense: if JCall really wanted to address Israelis, it would petition the Knesset — not the virulently anti-Israel European Parliament, which just two months ago backed the Goldstone Report’s allegations of Israeli “war crimes” in Gaza. The U.S. Congress, by comparison, denounced the report as hopelessly biased.

And that contrast highlights the more serious intellectual incoherence in JCall’s position. JCall, like JStreet, on which it is self-consciously modeled, opposes “delegitimization and boycotts of Israel,” Chemla told Haaretz. But America could reduce support for Israel in many ways short of boycott/divestment/sanctions. Europe can’t.

Unlike the U.S., the EU doesn’t vote against anti-Israel UN resolutions, give Israel financial aid, serve as a major Israeli arms supplier, and publicly defend (or at least refrain from condemning) Israeli counterterrorism measures. Indeed, it makes only one major contribution to Israel’s welfare: it’s Israel’s largest trading partner.

So when you urge European “pressure” on Israel, you’re effectively urging BDS. The EU has no lesser pressure mechanisms left.

Chemla nevertheless insisted that JCall is “actually helping Israel’s image in Europe” by showing that the Jewish community is “not monolithic.” How Europeans’ image of Israel would be improved by learning that prominent Jews also deem Israel the conflict’s main culprit remains a mystery.

But it’s no mystery how that might improve Europeans’ image of European Jews. On a continent where opinion polls consistently show Israel to be widely loathed, even implying that Israel isn’t solely to blame makes you suspect. But if you urge the EU to withhold support from Israel’s government, yet not from the PA; if you even declare that this serves Israel’s “true interests,” so Europeans need suffer no qualms of conscience, then you’ve restored yourself to the European consensus. You’ve showed, to quote JCall’s petition, that you, too, hear “the voice of reason” — at least as Europe currently defines it.

It’s hard being a Jew in Europe today. So it’s understandable that some would seize on anything, however irrational, that labels itself “pro-Israel” while not violating the European consensus. But their Israeli and American brethren must remind them of the truth: being “pro-Israel” in Europe today requires emphasizing Palestinian guilt, which Europeans routinely ignore, rather than reinforcing their “blame Israel” reflex. And it requires lobbying against “pressure” that can only be manifest through BDS.

A key concern of those who believe a nuclear Iran would be disastrous is that it would prompt “moderate” Arab states to switch into the Iranian camp — due to fear that America would be unable to protect them against a nuclear-armed neighbor and a desire to align themselves with the “strong horse,” which succeeded in going nuclear despite American opposition, rather than the “weak horse,” which proved unwilling or unable to prevent this development. But it now seems Iran won’t even need to obtain the bomb to make this happen: the growing realization that Washington has no real stomach for stopping it is enough.

This conclusion emerges from two incidents reported by Haaretz Arab affairs analyst Zvi Bar’el. First, Iran’s military exercises in the Persian Gulf this week were observed by “a high-level military delegation from Qatar. It was headed by Admiral Abed al-Rahim al-Janahi, who said his country wants to benefit from the Iranian experience, and that he was planning joint exercises for the two armies.”

This is particularly noteworthy given a fact that Bar’el didn’t mention: U.S. forces used Qatar’s Al Udeid Air Base for their campaigns in both Afghanistan and Iraq. Indeed, Qatar originally upgraded the base to lure the U.S. military. Now it’s planning joint military exercises with Iran.

Bar’el also quoted an Al-Arabiya interview with Turki al-Faisal, head of the King Faisal Institute of Global Strategic Studies — and also a former head of Saudi Arabian intelligence, a former ambassador to London and Washington, the Saudi foreign minister’s brother, and King Abdullah’s cousin. As such, Bar’el wrote, al-Faisal most likely represents the ruling family’s views.

And what are those views? Hitherto, Riyadh has considered Tehran its chief regional rival. But al-Faisal termed the Gulf states’ ties with Iran “historic ties that are built on interests, blood relationships and proximity.” He also opposed sanctions on Tehran, saying he prefers “dialogue,” and said Israel posed a far greater threat to the region than Iran does.

The prospect of a shift in Saudi Arabia’s allegiance ought to alarm even the Obama administration. Saudi Arabia is not only one of America’s main oil suppliers; it’s also the country Washington relies on to keep world oil markets stable — both by restraining fellow OPEC members from radical production cuts and by upping its own production to compensate for temporary shortfalls elsewhere.

Granted, Riyadh is motivated partly by self-interest: unlike some of its OPEC colleagues, it understands that keeping oil prices too high for too long would do more to spur alternative-energy development than any amount of global-warming hysteria. And since its economy depends on oil exports, encouraging alternative energy is the last thing it wants to do.

Nevertheless, the fact remains that Saudi Arabia has been generally effective as stabilizer-in-chief of world oil markets and has no plausible replacement in this role. And since the U.S. economy remains highly oil-dependent, a Saudi shift into Iran’s camp would effectively put America’s economy at the mercy of the mullahs in Tehran.

That’s a prospect that ought to keep Washington policymakers awake at night.

Anyone familiar with Israeli politics knows that the Israeli right’s worst enemy is itself. Small right-of-center factions toppled both Yitzhak Shamir’s Likud-led government in 1992 and Benjamin Netanyahu’s first government in 1999; those decisions led, respectively, to Yitzhak Rabin’s election and the Oslo Accords, and to Ehud Barak’s election and the second intifada.

Moreover, it was rightist voters who ensured Rabin’s victory by wasting thousands of votes on splinter parties that failed to enter the Knesset. Had all those votes gone to the main center-right party, Likud, Shamir would have formed the next government and not Rabin. Yet instead of learning the lesson, rightists continued wasting thousands of votes on unelectable splinter parties in subsequent elections.

So it was encouraging to read the following notice in a local newsletter (Hebrew only) published by the West Bank settlement of Eli: “After much thought, it has been decided by the [Givat Hayovel neighborhood] committee, the town council and rabbis, with backing from senior officials involved in the matter, to register people for Likud. Likud is the ruling party, and that is where we need to have an influence. … Joining Likud is the most effective way of influencing ministers and Knesset members to work with us on both the court case and other matters of importance to the town.”

Granted, Eli is only one settlement, and its decision stems from a very specific problem: the aforementioned court case, in which Peace Now is seeking a court order to raze Givat Hayovel on the grounds that it was built illegally. Eli contends that the neighborhood, built with massive government support, was always slated for legalization and needs only the final government permits — hence its quest for lobbying clout.

Nevertheless, this is a revolution. During Likud’s last membership drive, in 2008, a party activist who canvassed Eli and other settlements using this very same argument told me despairingly that most people didn’t get it. Now it is being promoted by the town’s entire political and religious leadership.

Moreover, many other settlements face similar problems with permits. So if Eli has reached this conclusion, it’s likely that other settlements are or will be doing the same.

This still doesn’t solve the problem of splinter voting, since joining Likud doesn’t oblige one to vote for it. Yet large-scale party membership carries its own dynamic: if those rightists who previously shunned Likud instead start working from within it, the party will presumably become more responsive to their needs, thus encouraging more of them to vote for it.

That in turn could promote more effective government. Israel’s current governing coalition comprises six different parties, with Likud commanding barely a third of its seats, and these parties’ disagreements have led to paralysis on many issues. A government composed of a larger Likud with fewer coalition partners would presumably find it easier to push through vital domestic initiatives.

That still remains a distant dream. But the first step is for rightists to understand that they need to work from within Likud rather than outside it. And it seems that is finally starting to happen.

In his post yesterday, Max posited that U.S-Israeli tensions make an Israeli strike on Iran unlikely. But in fact, such tensions may well make an Israeli strike more likely.

There are Israelis who believe that what currently looks like the only alternative — containing a nuclear Iran — is possible in principle. But for Israeli policymakers to conclude that containment is possible in practice, they must be convinced that if a nuclear Iran uses its enhanced power to attack Israel, whether directly or via its proxies in Lebanon and Gaza, the U.S. will either take appropriate countermeasures itself or support Israel in any countermeasures it deems necessary, including military ones.

If Israel’s relationship with Washington were close enough to make this conviction plausible, one could imagine Jerusalem reluctantly acquiescing should Washington ultimately decide that containment was the way to go. But given President Barack Obama’s track record, both of failing to take strong measures against thugs and of giving short shrift to Israeli concerns, virtually no one in Israel’s government thinks he can be trusted either to contain Iran himself or to allow Israel to do so.

Thus, for Israel to refrain from bombing Iran under these circumstances, it would have to conclude that an uncontained Iran is worse than the risk of widening the rift with Washington. And there is no historical precedent for Israel putting its relationship with any foreign government above a security threat of that magnitude, however much it agonizes over the decision beforehand.

I’m sure the Wall Street Journal article Max cited was accurate in saying that some Israeli defense officials do oppose bombing Iran without Washington’s consent (though based on experience, even their views could change as the threat of a nuclear Iran looms closer). But as the Journal itself acknowledged, even today, this opinion is far from unanimous. And if you want to gauge its relative strength within Israel’s policymaking establishment, it’s worth noting that the leading opponent of military action against Iran, IDF Chief of Staff Gabi Ashkenazi, has just been handed his walking papers.

Ashkenazi is widely admired in Israel for both his success in rehabilitating the Israel Defense Forces after the Second Lebanon War in 2006 and his conduct of last year’s war in Gaza. So there would be no good reason not to extend his term for a fifth year, which he reportedly wanted — except in order to keep the option of military action against Iran open. As Haaretz military correspondent Amos Harel noted in analyzing the implications of this decision, “An attack on Iran is impossible with a chief of staff who opposes it.” And Ashkenazi did oppose it — so strongly that the Pentagon reportedly viewed him as its most reliably ally in preventing an Israeli strike.

There is no guarantee that Israel will bomb Iran. Much could happen before Ashkenazi’s term ends in another 10 months, and his successor has not yet even been chosen. But to assert that U.S.-Israel tension takes the Israeli military option off the table is to misread both Israeli history and current events.

Why Israel Needs a Better Political Class

Israel’s current political crisis exemplifies the maxim that hard cases make bad law. This case is desperate. Six months after the coronavirus erupted and nine months after the fiscal year began, Israel still lacks both a functioning contact-tracing system and an approved 2020 budget, mainly because Prime Minister Benjamin Netanyahu is more worried about politics than the domestic problems that Israel now confronts. The government’s failure to perform these basic tasks obviously invites the conclusion that civil servants’ far-reaching powers must not only be preserved, but perhaps even increased.

This would be the wrong conclusion. Bureaucrats, especially when they have great power, are vulnerable to the same ills as elected politicians. But unlike politicians, they are completely unaccountable to the public.

That doesn’t mean Haviv Rettig Gur is wrong to deem them indispensable. They provide institutional memory, flesh out elected officials’ policies, and supply information the politicians may not know and options they may not have considered. Yet the current crisis shows in several ways why they neither can nor should substitute for elected politicians.

First, bureaucrats are no less prone to poor judgment than politicians. As evidence, consider Siegal Sadetzki, part of the Netanyahu-led triumvirate that ran Israel’s initial response to the coronavirus. It’s unsurprising that Gur never mentioned Sadetzki even as he lauded the triumvirate’s third member, former Health Ministry Director General Moshe Bar Siman-Tov; she and her fellow Health Ministry staffers are a major reason why Israel still lacks a functional test-and-trace system.

Sadetzki, an epidemiologist, was the ministry’s director of public-health services and the only member of the triumvirate with professional expertise in epidemics (Bar Siman-Tov is an economist). As such, her input was crucial. Yet she adamantly opposed expanding virus testing, even publicly asserting that “Too much testing will increase complacence.” She opposed letting organizations outside the public-health system do lab work for coronavirus tests, even though the system was overwhelmed. She opposed sewage monitoring to track the spread of the virus. And on, and on.

Moreover, even after acknowledging that test-and-trace was necessary, ministry bureaucrats insisted for months that their ministry do the tracing despite its glaringly inadequate manpower. Only in August was the job finally given to the army, which does have the requisite personnel. And the system still isn’t fully operational.
